Korea is a first-to-file jurisdiction. Two parties with the same idea are separated by the filing date alone, so it is safer to begin the review while the idea is taking shape rather than after development wraps up.

Disclosure, sale, or an investor presentation can destroy novelty and make registration difficult. If an exhibition or a paper is coming up, decide on filing beforehand. Where disclosure has already happened, a grace-period exception may still be available within twelve months.

Most of what determines registrability shows up in the prior-art search. Filing without one usually means changing direction only after an office action arrives, which costs both time and money.

Can we file with only an idea?+

Yes, provided it is concrete enough to be written as claims. We will tell you in the consultation how far it needs to be worked out.

Patent or utility model?+

A utility model is limited to the shape or structure of an article and lasts ten years, but examination is faster. We recommend whichever fits the technology and your business schedule.

We already disclosed the invention. Is it too late?+

A grace-period exception may apply within twelve months of disclosure. Foreign jurisdictions treat this differently, so the decision should be made quickly.

What does it cost?+

Official fees plus attorney fees, varying with the technical field and the number of claims. We put stage-by-stage figures in writing before starting.

Should we file abroad as well?+
